This Affiliate Program Agreement ("Agreement") governs participation in the LifeandHomes Affiliate Program ("Affiliate Program") operated by LifeandHomes ("LifeandHomes," "we," "us," or "our").
By applying to, enrolling in, or participating in the Affiliate Program, you ("Affiliate," "you," or "your") agree to be bound by this Agreement.
The LifeandHomes Affiliate Program allows approved affiliates to promote LifeandHomes products and services and earn commissions for qualifying referrals that result in paid subscriptions or other qualifying actions as defined by LifeandHomes.
Participation in the Affiliate Program does not create an employment, partnership, joint venture, franchise, or agency relationship.
Affiliates must be at least eighteen (18) years of age and capable of entering into binding legal agreements. Enrollment is subject to approval by LifeandHomes in its sole discretion.
LifeandHomes reserves the right to reject or revoke Affiliate participation at any time, with or without cause.
Affiliates agree to promote LifeandHomes honestly, lawfully, and in a manner consistent with applicable advertising, consumer protection, and disclosure laws.
Affiliates may not make false, misleading, or unsubstantiated claims regarding LifeandHomes services, performance, pricing, results, lead volume, or outcomes.
Affiliates must clearly disclose their affiliate relationship in accordance with Federal Trade Commission (FTC) endorsement and disclosure guidelines or other applicable regulations.
Affiliates may not impersonate LifeandHomes, represent themselves as employees or agents, or suggest an official partnership beyond participation in the Affiliate Program.
Affiliates may not engage in deceptive, abusive, or unlawful marketing practices, including but not limited to spam, unsolicited communications, misleading advertisements, false scarcity, unauthorized paid advertising using LifeandHomes trademarks, domain squatting, or misrepresentation of pricing or services.
Affiliates may not bid on or otherwise misuse LifeandHomes trademarks, brand names, or confusingly similar terms in paid advertising without express written permission.
LifeandHomes reserves the right to determine whether an Affiliate's marketing practices violate this Agreement.
Referrals are tracked using links, cookies, or other attribution mechanisms determined by LifeandHomes. LifeandHomes does not guarantee tracking accuracy and is not responsible for lost or uncredited referrals due to technical issues, user behavior, browser settings, or third-party interference.
Only referrals that are properly tracked, verified, and accepted by LifeandHomes qualify for commissions.
Commission rates, qualification requirements, payment schedules, and payout methods are established by LifeandHomes and may vary by program tier or promotional period.
Commissions are earned only on qualifying transactions that result in collected payment and are not subject to refunds, chargebacks, cancellations, fraud, or abuse.
LifeandHomes reserves the right to withhold, adjust, or reverse commissions in cases of suspected fraud, policy violations, or invalid referrals.
Affiliates are solely responsible for all taxes, reporting obligations, and compliance arising from commissions earned under the Affiliate Program. LifeandHomes does not provide tax advice.
LifeandHomes grants Affiliates a limited, non-exclusive, revocable license to use approved LifeandHomes trademarks, logos, and marketing materials solely for participation in the Affiliate Program.
Affiliates may not modify, alter, or create derivative versions of LifeandHomes intellectual property without prior written consent.
All goodwill arising from Affiliate use of LifeandHomes intellectual property inures solely to LifeandHomes.
Affiliates may receive access to referral performance data limited to their own account. Affiliates may not access, collect, store, sell, or misuse personal data of LifeandHomes users, leads, or customers.
Affiliate data is processed in accordance with the LifeandHomes Privacy Policy.
Either party may terminate Affiliate participation at any time. LifeandHomes may terminate immediately for violations of this Agreement, fraudulent activity, deceptive practices, or conduct that harms the LifeandHomes brand or platform.
Upon termination, Affiliates must cease all use of LifeandHomes intellectual property and promotional materials.
LifeandHomes may withhold unpaid commissions in cases involving fraud or material breach.
The Affiliate Program is provided "as is" and "as available." LifeandHomes makes no guarantees regarding earnings, conversion rates, referral success, or program availability.
Participation in the Affiliate Program does not guarantee income or continued eligibility.
To the maximum extent permitted by law, LifeandHomes shall not be liable for indirect, incidental, consequential, or punitive damages arising from Affiliate participation.
Total liability shall not exceed commissions paid to the Affiliate during the twelve (12) months preceding the claim.
Affiliates agree to indemnify and hold harmless LifeandHomes from claims, damages, losses, and expenses arising from Affiliate marketing activities, representations, policy violations, or misuse of the Affiliate Program.
This Agreement is governed by the laws of the State of New York. Exclusive venue lies in state or federal courts located in New York.
LifeandHomes may modify this Agreement at any time. Continued participation in the Affiliate Program following posted changes constitutes acceptance of the revised Agreement.
This Agreement constitutes the entire agreement between the parties regarding the Affiliate Program and supersedes prior discussions or agreements related to affiliate participation.
